Overview

This guide outlines Ebury's regulatory status and safeguarding policies. It explains how Ebury protects client funds and the specific regulatory framework governing EMIs.

Key takeaways
Ebury is licensed as an Electronic Money Institution by the Financial Conduct Authority in the UK.
Ebury has a legal obligation to safeguard client account balances.
In the unlikely event that Ebury ceases trading, any client funds held in client accounts subject to safeguarding are protected (ring-fenced) from Ebury’s other creditors.
This gives you peace of mind knowing that your funds are protected.

Our commitment to you

As an FCA-licensed Electronic Money Institution, we are legally obliged to safeguard your funds.

We safeguard your funds by keeping them in designated segregated accounts with Tier 1 banks. By ring-fencing your balances from our own business operations, we ensure your money remains protected and accessible, even if we stop trading.

These partners, which are used to hold client funds, are carefully selected and regularly reviewed based on several factors, including but not limited to reputational risk, agency ratings, service capabilities, and local market presence.

Safeguarding structure

We reconcile your funds the moment arrive and ensure they are ring-fenced in dedicated accounts within one business day.

Ebury performs daily safeguarding calculations for regulated entities, as required under relevant regulations such as the Electronic Money Regulations 2017, with further guidance in the FCA's Payment Services and Electronic Money - Our Approach document.

All safeguarding processes ensure that funds are appropriately protected in line with the client’s agreed terms and conditions and the governing regulations.

Margins

When you transfer funds as margin, they are held under a title transfer collateral arrangement to cover your financial obligations to Ebury.

This means that once we receive the funds, ownership officially transfers to us. It is important to note that in the unlikely event Ebury stops trading, you would typically be considered an unsecured creditor regarding these funds.

Deposit guarantee schemes

As an Electronic Money Institution (EMI), Ebury is regulated differently than a traditional bank. This means we don’t fall under deposit guarantee schemes like the Financial Services Compensation Scheme (FSCS). While this regulatory framework is distinct, we follow strict industry standards to ensure we manage your funds securely and transparently.
