Overview
This guide outlines Ebury's regulatory status and safeguarding policies. It explains how Ebury safeguards end-user funds under the framework governing payment service providers (PSPs) in Canada.
Key takeaways
Our commitment to you
Our safeguarding obligations can be satisfied in a number of ways. Currently, Ebury satisfies them by segregating end-user funds in designated safeguarding trust accounts with Tier-1 banks*.
Ebury selects and regularly reviews the institutions used to hold end-user funds based on a number of factors, including reputational risk, agency ratings, service capabilities and local market presence.
*This is our current bank (Bank of America), and we are in the process of opening further safeguarding trust accounts with other Tier-1 banks. These may be subject to change depending on market conditions and ongoing reviews.
Safeguarding structure
We reconcile end-user funds immediately upon receipt, and we meet our safeguarding obligations for these funds within one business day.
Ebury performs daily safeguarding calculations for regulated entities, as required by applicable regulations. Under the Bank of Canada's Retail Payment Activities Act (RPAA), PSPs such as Ebury must protect end-user funds by holding them in a separate safeguarding trust account.
All safeguarding processes ensure end-user funds align with agreed terms and conditions and governing regulations.
Margins
Margin in the form of funds may be transferred to Ebury under title transfer collateral arrangements, for the purpose of securing or otherwise covering the performance of financial obligations owed to Ebury. Accordingly, ownership of these funds transfers to Ebury upon receipt.
If Ebury ceases trading, the provider of this margin will generally be an unsecured creditor.
